Terms of Service

These terms govern your use of cur8r.xyz and the briefings published there ("Cur8r," "the Service"), operated by Emperox LLC, a Minnesota limited liability company ("we," "us"). By accessing or using the Service you agree to them. If you don't, please don't use it.

You must be at least 18 years old to use the Service.

What Cur8r is

Cur8r publishes curated intelligence briefings. Each channel gathers material from public sources, scores it against explicit editorial criteria for a defined audience, and publishes a written briefing and an audio version.

The Service is free. There are no accounts, nothing to buy, and nothing to sign up for. Channels marked "coming soon" are not yet publishing.

How our briefings are made

We think you should know this, so it's in the terms rather than buried somewhere.

Cur8r briefings are produced with substantial help from automated systems, including large language models, for source gathering, scoring, drafting, and speech synthesis. Every briefing passes an editorial quality gate and is reviewed and approved by a person before it publishes. Audio narration is synthetic.

We work hard on accuracy, but automated systems make mistakes, and so do people. Briefings are journalism and commentary — background for your own thinking, not professional advice. Nothing in a Cur8r briefing is investment, legal, financial, medical, or career advice. Verify anything you plan to act on, and follow the source links; we include them for exactly this reason.

If you spot an error, tell us at cur8r@emperox.com. We correct things.

Third-party content and links

Briefings quote, summarize, and link to material published by others. That material belongs to whoever created it, and quotation is done for commentary and reporting. We don't control what's on the other end of a link and we're not responsible for it. Following a link means you're subject to that site's own terms and privacy policy.

If you own something we've featured and want it corrected or removed, email cur8r@emperox.com and we'll respond promptly.

What you may do with our briefings

The original material we create — briefing text, editorial commentary, audio narration, artwork, the Cur8r name and logo — belongs to Emperox LLC and is protected by copyright and trademark law. These terms grant you a limited, non-exclusive, non-transferable, revocable license to access and read or listen to the Service for your own personal, non-commercial purposes. All rights not expressly granted are reserved.

You're welcome to read, listen, and share. Specifically, you may quote briefly with attribution and a link, share links freely, and forward a briefing to a colleague.

Please don't republish briefings in full, remove attribution or proprietary notices, present our work as your own, use our name or logo to imply we endorse you, or scrape the Service in bulk — including for training machine learning models — without written permission. If you want to do something not covered here, just ask.

Feedback

If you send us feedback or suggestions about the Service, you grant us a perpetual, irrevocable, worldwide, non-exclusive, fully-paid, royalty-free license to use it for any purpose, without attribution or compensation. Please don't send us anything you consider confidential or proprietary.

Acceptable use

Don't attempt to break, overload, or gain unauthorized access to the Service; don't reverse-engineer or build a competing service from it; don't use it to violate the law or anyone's rights. We may block access for any of these.

Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these terms by reference. In short: we set no cookies, run no trackers, and collect no personal information from visitors. If these terms and the Privacy Policy ever conflict on a question about personal data, the Privacy Policy controls.

Availability

The Service is provided as-is. We don't promise it will be available, uninterrupted, error-free, or that any particular channel will keep publishing on any schedule — or begin publishing at all. We may change, suspend, or discontinue any part of it, including a whole channel, at any time. We'll try to give notice when we can. We have no obligation to provide support or maintenance.

Disclaimer of warranties

To the fullest extent the law allows, the Service and everything on it are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, or accuracy. We do not warrant that the Service will meet your needs, that it will be secure or free of harmful code, or that any information in a briefing is complete, current, or correct.

Some jurisdictions don't allow certain warranty exclusions, so parts of this may not apply to you.

Limitation of liability

To the fullest extent the law allows, Emperox LLC and its members, officers, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of your use of the Service — even if we've been told such damages are possible.

Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100), which reflects that the Service is provided free of charge. The existence of multiple claims does not increase this cap.

Nothing here limits liability that cannot be limited by law, including for fraud or willful misconduct.

Indemnification

You agree to defend, indemnify, and hold harmless Emperox LLC and its members, officers, and contractors from any claim, and reasonable costs and attorneys' fees, arising out of your misuse of the Service, your violation of these terms, or your violation of any law or anyone's rights. We may assume control of the defense of any such claim at your expense, and you agree to cooperate. You may not settle any such claim without our written consent.

Release

To the fullest extent permitted by law, you release Emperox LLC and its members, officers, contractors, successors, and assigns from all claims, demands, and damages arising out of or related to the Service or any third-party site it links to.

If you are a California resident, you waive California Civil Code Section 1542, which provides: "A general release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor or released party."

State-specific notices

These provisions apply only to users subject to the laws of the states named. Where one conflicts with another provision of these terms, it controls for users subject to that state's laws.

California. Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice. The provider of the Service is Emperox LLC, 400 S 4th St Ste 410 #63946, Minneapolis, MN 55415 US. To file a complaint regarding the Service, or to receive further information regarding its use, write to that address or email cur8r@emperox.com. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 N. Market Blvd., Suite N112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

California residents may also have rights under the California Consumer Privacy Act, as amended. See our Privacy Policy.

Other states. Residents of Colorado, Connecticut, Virginia, Minnesota, Nevada, and other states with comprehensive consumer privacy laws may have additional rights regarding personal data. Because Cur8r collects no personal information from visitors, most of these rights have nothing to attach to — but the Privacy Policy describes what's available and how to exercise it.

Accessibility

We want the Service to be usable by everyone, including people with disabilities, and we work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. If you have trouble accessing or navigating any part of the Service, or have a suggestion for improving it, email cur8r@emperox.com. We'll make reasonable efforts to address the problem promptly.

Electronic communications

By using the Service, you consent to receiving communications from us electronically, whether by email or by notices posted on the Service. Those electronic communications satisfy any legal requirement that a communication be in writing.

Changes to these terms

We may update these terms. The version and date at the top change when we do, and material changes will be flagged on the Service. Continuing to use Cur8r after a change means you accept the updated terms.

Governing law

Emperox LLC is organized under Minnesota Statutes Chapter 322C. These terms are governed by the laws of the State of Minnesota, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Hennepin County, Minnesota, and you and we each consent to that jurisdiction.

Two exceptions: either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property, and either party may bring an individual action in small claims court within that court's limits.

Miscellaneous

If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and if that isn't possible it will be severed and the rest stays in force. Our not enforcing a provision isn't a waiver of it. "Including" means "including without limitation." These terms and the Privacy Policy are the entire agreement between us about the Service. You may not assign them; we may, in connection with a merger or sale of the business.

If you stop using the Service, the sections on intellectual property, feedback, disclaimers, limitation of liability, indemnification, release, governing law, and this section survive.
